Default 2002 Focus SE Transmission Slipping

Newly purchased 02 wagon for my mother, from a private seller, pre-purchase inspection from local Ford dealer everything checked out OK. Car 90k miles, good condition or so it appeared. Car has driven fine for the first 500 miles then tonight the car transmission started to slip when traveling over 40 mph's. Temp is lower 30's, car was driven only 10 miles when it stared to occur.

It only slips when the car is shifting into overdrive. When I say slip, the transmission appears to totally disengage. There is a fairly hard shudder when it appears to fail to shift into overdrive. The transmission when shifted into second does not slip, the car can be shifted back into drive but when it shifts into overdrive it slips again. If the overdrive is turned off and the car is in drive it does not slip. I appears to be an issue with when the car attempts to shift into overdrive, 40+ mph.

Any suggestions, I do not have the manual so I'm not sure the correct procedure on checking the fluid level. I checked the fluid when the car is warm, level surface, etc... appears to be at the correct level, though the fluid is clear, not a red color.

No warning lights.
